Representation agreement

A representation agreement is the contract between a model and an agency: how long the agency will represent the model, both sides' duties, the commission and how payment works.

How it works

It is the model's core document. It should state the parties, the term and how to terminate, the duties of the agency and the model, the commission, the costs the agency may advance and how disputes are settled. A parent signs for a minor.

A normal term is one to three years with an option to renew. The agreement should oblige the agency to offer work and leave the model free to refuse a job that does not suit them.

Never sign on the spot. Take the draft home, read it, mark what is unclear and ask for explanations in writing. Show it to a lawyer if you can.

In practice

After the meeting the agency gives the family a draft contract to take home. The parents read it and mark three clauses: a five-year term, a fine for refusing a trip and a vague usage clause. The agency explains, shortens the term to two years, strikes the fine and ties usage to each job's confirmation. Only then is the contract signed.

What to watch for

  • Red flags: a 5–10 year term, fines for refusing work, a fee to sign.
  • The agreement should say you will receive a statement.
  • Keep your signed copy and every annex.
